This statement on the Rookes v Barnard case was published by the Draughtsmen's and Allied Technicians' Association in 1964. In 1963, the House of Lords ruled that Rookes (who had resigned from DATA) had been dismissed because the union had threatened to strike in support of the closed shop and was entitled to damages from the union. This decision showed that the Trade Disputes Act 1906 did not give unions the protection they had assumed. The House of Lords ruling was quashed by the Trade Disputes Act 1965.
